GENERAL

This website https://mywayusa.shop (the “Website”) is owned and operated by Northerner Scandinavia Inc., company reg. no. 26-4502398 (”MyWayUSA”, “we”, “us”, “our”). The Website is open for purchases by consumers 21 years or older residing in the USA. Please review these terms of sale (“Terms”) carefully as this document governs your purchase of products from MyWayUSA and contains important information about limitations and exclusions that may apply to you.

By placing your order, you confirm that you have read, accepted, and agreed to comply with these Terms. You also acknowledge that you have read and understood the Privacy Policy.

MyWayUSA reserves the right to change these Terms at any time. Every change will be published on the Website and apply to you upon your placement of a new order.

ORDERING PRODUCTS AT THE WEBSITE

MyWayUSA offers such tobacco and nicotine products as available on the Website from time to time. The images of the products are for illustrative purposes only and the products may vary slightly from those images.

By placing an order with MyWayUSA you represent and warrant that you are a consumer and at least 21 years old having a delivery address in the USA.

Please note that MyWayUSA may apply a maximum limit of cans per customer per a certain time frame as further set out on the Website from time to time, and that we reserve the right to refuse and/or revoke an order e.g. due to such limitation, and/or limit quantities in any order at our sole discretion. When we have accepted your payment, confirmed your order through a confirmation e-mail to the email address you provided when placing the order, and the products have been dispatched the purchase agreement will be concluded.  

AGE VERIFICATION AND PREVENTION OF YOUTH ACCESS

At MyWayUSA we apply a strict age limit of 21 years although there may be state laws that may allow for a lower age requirement. In order to place an order, you will be asked to verify your age through our third-party vendor for on-site age verification (Agechecker). If the verification fails and/or public records don’t align, you must upload a valid and unexpired government-issued ID for extended age verification.  MyWayUSA may at all times deny and/or cancel the order if proper identification cannot be provided and/or age verification cannot be undertaken.

In addition to confirming your age yourself, you as a cardholder need to be 21 years or older to complete the transaction. An order made in another person’s name (falsification of a document), or in any other way that causes MyWayUSA to risk a financial damage, will be reported to the relevant authorities. We reserve the right to refuse to carry out an order if irregularities or misuse of our order function are suspected.

PRODUCT INFORMATION

MyWayUSA strives to make sure that all information provided on the Website is correct, but with reservations for limited availabilities and possible errors in pictures or writing, e.g. errors in product descriptions, incorrect prices, or erroneous information about stock availability. MyWayUSA furthermore reserves the right to correct such errors at any time and change or update information. All pictures on the Website are intended as illustrations only and do not guarantee the exact appearance or condition of the product.

PRICE AND PAYMENT

The prices listed on the Website before the checkout are base prices, to which applicable taxes will be added. You may also be eligible for discounts as offered from time to time by MyWayUSA. All prices and fees and charges (e.g. adult signature requirement (ASR) fee, shipping fees and taxes) on the Website are displayed and charged in USD ($). As further set out below, an additional fee may be charged in case of an unredeemed package.

Before completing your order at the checkout, you must choose the delivery method, after which the costs for your order, including ASR fee where applicable, shipping costs and applicable taxes including sales taxes and State Excise Tax (SET), based on your location, will be calculated and added.

We provide payment options via debit or credit cards through our partners PayPal, Stripe, and Klarna. The respective payment service provider’s terms and conditions apply to the payment. By using a payment method, you represent and warrant that you are authorized to use that designated payment method. If you are not eligible for the chosen payment method e.g. if your debit or credit card cannot be verified, is invalid or is otherwise not acceptable your order may be suspended or cancelled automatically.

SHIPPING

Due to certain state regulations governing the online sale of tobacco and nicotine products, MyWayUSA is unable to deliver to every state in the USA. The available shipping options and the shipping costs for each shipping option will be presented in the checkout at the Website. The shipping cost is specified during checkout when placing an order at the Website. Subject to selecting a shipping option and filling in your shipping address in the checkout you will view the shipping cost in your order summary in the checkout.

You will receive a shipping confirmation once your order has been dispatched from MyWayUSA’s warehouse. We strive to ship all orders promptly. It may however take a few days before you receive the shipping confirmation email.

Certain states require adult signature upon delivery in addition to age verification on site. If there is such a requirement in your state, you acknowledge that MyWayUSA’s shipping carrier will attempt delivery up to three times. You agree that if such delivery is unsuccessful, your package will be returned to MyWayUSA at your cost.\

A package shipped according to any of our delivery alternatives will either be sent back to MyWayUSA or discarded if you have not been able to redeem it. You agree to pay any costs associated with an unredeemed package.


RETURNS

We do not accept returns since our products are fresh with a limited shelf life. However, if there was a problem with your order or if the product doesn’t meet your expectations, you can contact our customer service team to request a refund. The right of complaint only includes defects at delivery (and not defects that for instance occurred due to the product’s expired shelf life or due to normal wear and tear). You need to notify MyWayUSA about the defect at the latest within ten days after you received the product. We therefore recommend you to carefully inspect the products directly upon receiving them. Please note, the time frame for compensation to be issued to orders is 60 days.


Depending on the type of product defect we may require you to provide photographic proof. Throughout the complaints period you are required to retain original packaging, packing slip and the products in question.


Depending on the type of defect we may provide a replacement product, remediation, or a price reduction. For further claims, exceeding the costs of the product, MyWayUSA agrees to comply with mandatory applicable consumer legislation governing the purchase. Any other liability is hereby expressly excluded.

Title to the product passes from us to you upon shipment, and we are not responsible for any shipping delays or problems once the product has been shipped. However, in the event of damages during shipment, you may reach out to our Customer Service team, and we will try to help out. We kindly ask you to keep the product packaging for inspection. In order to make a claim regarding your products, you will also need to prove your purchase from the Website, for instance through the order confirmation or the receipt MyWayUSA sent to the e-mail address you provided in connection with your purchase. We may also request photographic proof of damages.

EVENTS OUTSIDE OF OUR CONTROL

MyWayUSA is not required to comply with these Terms when there is an event outside of our control (Force Majeure), which includes e.g. changed legislation, government measures, strikes, blockades, sabotage, war, terrorism, fire, floods, natural disasters, epidemic or other extraordinary events. Such an event will also relieve Northerner from the obligation to pay any compensation to you. If a Force Majeure event lasts longer than two (2) months, both you and MyWayUSA have the right to cancel the purchase with immediate effect.
